A. General Terms and Conditions of bululu.de
§ 1 Scope of these terms and conditions
1. the operator of the bululu.de portal is 3BS GmbH, represented by the managing director Wolfgang Schiffke.
2 The following terms and conditions apply to all users of the bululu.de portal and the services offered on the portal. Users are understood by bululu.de to include both applicants and employers.
3. both parties are hereinafter referred to as users.
4 We would like to point out special conditions for applicants (see I.) and employers (see II.).
5. every user of the portal enters into a contractual relationship through its use. Changes are only valid with a written confirmation.
6. bululu.de reserves the right to change the above conditions at any time.
§ 2 Contents
1. bululu.de is an online job exchange. Applicants and employers can use it to inform each other and express their willingness to meet.
2. bululu.de organises its offering into six areas:
Vacancies
Job applications
Advertising platform
Information area on the topics of applications/job advertisements
Training (webinar/publications)
Entertainment platform
§ 3 Payment obligations
bululu.de is free of charge for employees and employers, but offers employers specially labelled options for fee-based publications.
§ 4 Exclusion of warranty
1. bululu.de does not guarantee the chances of success but only creates the opportunity for the respective parties to come together.
§ 5 Copyrights, data rights and data protection.
1. all copyrights and other rights to are on bululu.de
2. users can use the portal after registration.
3. the respective user guarantees that all texts and images published by him/her and forwarded to bululu.de are free of third-party rights and do not violate any other rights.
§ 6 Liability
1. bululu.de is liable for fraudulently concealed or wilfully misinformed facts.
2. bululu.de's overall liability in the event of a material breach of contractual obligations is limited to the foreseeable actual damage.
§ 7 Miscellaneous
1. if the user is a merchant according to §1 of the German Commercial Code (HGB) or another public person, the place of jurisdiction is Kleve.
2 Should any provision of these GTC be invalid, this shall not affect the validity of the remaining provisions.
I. Further terms and conditions for applicants
The following special terms and conditions apply to all applicants who wish to use bululu.de.
§ 1 Registration, creation and deletion of master data
1. registration is essential for certain offers on bululu.de, subject to acceptance of these terms and conditions, with the provision of personal data (user name, password, email, etc.). The user must log in with his/her unique personal and non-transferable data.
2. the contract can be cancelled at any time without notice.
3. the applicant does not have any ownership rights to the account set up beyond the right to use the portal.
4. bululu.de reserves the right to delete an account in the event of prolonged inactivity.
§ 2 Data protection and data quality
1. bululu.de guarantees to treat the data entered confidentially and to use personal data only within the framework of the legal conditions. You may object to the use of your data at any time.
2. bululu.de accepts no responsibility for the accuracy of the data provided by the applicant.
II. Further terms and conditions for employers
The following additional terms and conditions apply to potential employers who present themselves on the bululu.de job exchange and create a company profile and/or place job adverts or present themselves in any other way.
§ 1 Conclusion of contract
Contracts with bululu.de are concluded when we receive an original contract with the date and exact address of an acceptance of an offer. Amended contracts require written confirmation.
§ 2 Payment obligations and payment modalities
1. in addition to the free job adverts, employers also have the opportunity to take advantage of offers subject to a charge in accordance with the published price list.
2. unless otherwise agreed in writing, the term of payment is 7 days after publication.
3. bululu.de reserves the right to withdraw published adverts if payment is not made within the specified terms.
§ 3 Placement of job adverts
1. contracts are concluded for a fixed period of time and end automatically when this period is reached. The standard term is 4 weeks.
2. if the employer specifies layout requirements, we will implement these to the best of our ability.
3. bululu.de accepts no liability whatsoever for the data material supplied.
§ 4 Claims for defects
1. bululu.de guarantees claims for defects against the employer in accordance with the technical standard.
2. claims for defects against bululu.de in the case of not insignificant deviations from the agreed quality must be reported immediately and will be implemented by bululu.de as quickly as possible. Liability for defects will be refunded with an extension of the respective service or with reimbursement of costs if the publication cannot be improved.
3. the limitation period for claims against employers is 1 year from the date on which the employer becomes aware of them.
§ 5 Imprint obligation, data protection law and liability
1. the employer appearing at bululu.de is obliged to leave his complete data according to the legal imprint obligation.
2. the employer assumes liability for data used illegally by him (image, logo, film files, ...)
3. the respective employer agrees that bululu.de also publishes the job advertisements on other platforms in order to achieve a higher success rate.
